图片不能乱下载使用,会有法律诉讼的今天无聊刷网友的公众号,忽然看到有人说,公众号里的图片不能乱下载,否则会被原创者发律师函。评论区里不少网友现身说法,说自己已经收到过律师函,赔了钱,少的赔一两百,多的赔上万。自己辛辛苦苦写了好久文章,收入连几十块都没有,结果一赔就是上百起步。看完真让人后背发凉。我赶紧去问DeepSeek,结果是真的——公众号里的“网图”和“AI图”都不能随意用,风险很高。1. 网上随便下载的图,是侵权“重灾区”
- “非盈利”不代表免责:只要公开传播,就可能损害原作者的潜在收入,哪怕你是公益号也算侵权。
- “注明来源”或“侵删”也没用:法律要求“先授权后使用”,单方面声明不能免责。
- 赔偿不便宜:一张图可能赔几百到几千元,如果是视觉中国这类专业维权机构,赔偿额只会更高。
2. AI生成的图,版权属于“灰色地带”
可能“不受保护”:如果只是输入简单关键词(比如“红色背景、新年元素”),法院常认定为“指令性操作”,不体现人类独创性,不受著作权法保护。这意味着别人用了你的图,你大概率没法维权。也可能“受保护”:如果你投入了独创性(比如精细调整参数、反复修改细节),法院就可能判定受保护。还有附加侵权风险:即便AI图本身不受保护,如果它的内容模仿了某知名摄影师的风格,或者训练时用了未授权素材,使用它仍有被索赔的风险。看完这些,心里更凉了。以前法律意识不强,看到喜欢的网图就下载收藏,完全没意识到可能是违法的。看来还是得加强学习,以后老老实实用自己拍的照片吧!
